On 14 April 1981 application was made under the
Administrative Decisions (Judicial Review) Act 1977 (the
"Judicial Review Act") by Tooheys Limited seeking an order of review in respect of a decision made by the Delegate of the Honourable John Colinton Moore, Minister for Business and Consumer Affairs, under Part XVI of the Customs Act 1901. Under Part XVI the Minister 1s empowered to make by-laws or determinations in relation to goods for the purposes of items
