REASONS FOR JUDGMENT
On 22 October 1979 the returning officer who conducted an election for the filling of the office of Secretary of the Sydney Branch
of the Australian Institute of Marine and Power Engineers (the organization), an organization registered under the Conciliation and Arbitration Act 1904 (the Act) declared that one, Christopher Yule was the successful candidate. The said election was conducted pursuant to s.170 of the Act by Mr Lewis
