REASONS FOR JUDGMENT

This is the final hearing of an application for

judicial review pursuant to the Administrative Decisions

(Judicial Review) Act 1977 ("the ADJR Act"). The decision

called into question was made by a delegate of the respondent on 25 November 1986, wherein; (1) the applicant's application for resident status was refused; (2) the concession of a supervised voluntary departure from Australia was refused, and (3) an order was made under s.18 of the Migration Act 1958 ("the Migration Act"), for the deportation of the applicant.

The applicant seeks final orders in respect of matters (1) and (2) and costs. By "resident status", the subject of

matter (1), I understand the grant of an entry permit unlimited

in time. The proceedings in this court were instituted on 27 November 1986. Beaumont J. gave, on terms, interlocutory relief, which has been continued until further order. Evidence before me was on affidavit with no cross-examination. In support of the case for review, the applicant relied upon s. 5(1)(e), plus ss. 5(2)(b) and (j) and upon s. 5(1)(j) of the ADIR Act.
