REASONS FOR JUDGMENT
This is an application by White Constructions (A.C.T.) Pty. Limited ("White Constructions") for leave to appeal from that part of a judgment of the Supreme Court of the Australian Capital Territory (Miles C.J.) given on 6 February 1987 whereby it was ordered that further proceedings be stayed upon a counter-claim brought by White Constructions in proceedings (No. SC 1518 of 1986) pending in that Court between Glass Reinforced Products (GRP) Pty. Limited ("GRP") as plaintiff and White Constructions and the National Australia Bank Limited ("the Bank") as first and second defendants respectively. The judgment being interlocutory, leave to appeal is required by
s.24(1A) of the Federal Court of Australia Act 1976 (Cth).

The background to the disputation between the parties is that White Constructions is engaged in the construction in Canberra of a complex of buildings to be known as the Canberra National Convention Centre ("the Centre"). GRP contracted to supply, transport and erect glass reinforced concrete cladding panels for the buildings. Collateral arrangements were subsequently made for the pre-payment by White Constructions of
