FISHER J.: This is an appeal from a judgment of this Court in favour of the respondent Robert Ellwood ("Ellwood") in the sum of $57,500 against the appellant Darling Downs Investments Pty. Ltd. ("Darling Downs"). The judgment was entered ona notice of motion filed by Ellwood on 26 March 1987. He sought judgment against Darling Downs for the balance of an amount agreed to be paid pursuant to a compromise by the parties of proceedings under the Trade Practices Act 1974.
