The appeal be allowed. 2. Each of the orders made on 14 December 1994 in proceeding VP 944 be set aside. 3. In lieu thereof a sequestration order is made against the estate of the respondent debtor. 4. The costs of the appellant petitioning creditor of the petition be taxed and the appellants costs of the appeal be costs of the petitioning creditor in the application of s109 of the Bankruptcy Act 1966. Note: Settlement and entry of orders is dealt with in Order 36 of the Federal Court Rules.
