REASONS FOR JUDGMENT 1 This is an application under s 39B of the Judiciary Act 1903 (Cth) for review of a decision of the Refugee Review Tribunal (the RRT) given on 18 March 2002 affirming a decision of a delegate of the Minister for Immigration and Multicultural and Indigenous Affairs to refuse the applicant and her two infant children protection visas under the Migration Act 1958 (Cth) (the Act). The applicant claimed that she is a "refugee" within the meaning of the Refugees Convention as amended by the Refugees Protocol as those expressions are defined in s 5(1) of the Act. Article 1A(2) of the Refugees Convention defines a refugee as a person who: "… owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence as a result of such events, is unable or, owing to such fear, is unwilling to return to it."
