The defence of the first, second, third, fourth and seventh respondents filed on 3 May 2002 be struck out in consequence of the failure of those respondents to comply with the orders of 25 September 2003. THE COURT FURTHER ORDERS THAT: 3. The hearing of the application for judgment in accordance with O 35A r 3(2)(c) of the Federal Court Rules be adjourned to a date to be fixed. 4. The first, second, third, fourth and seventh respondents pay the applicant's costs, including any reserved costs, of the motion. Note: Settlement and entry of orders is dealt with in Order 36 of the Federal Court Rules.
