The Applicant in proceeding WAD 6004 of 2004 has brought a native title determination application (the Ngaanyatjarra Lands Application) that relates to an area that includes the land and waters the subject of the proposed determination of native title (Ngaanyatjarra Lands Determination). B. The Ngaanyatjarra Lands Application includes land and waters also covered by the native title determination applications brought in proceedings WAD 6030 of 1998, WAD 6041 of 1998, WAD 6101 of 1998, WAD 6103 of 1998, WAD 6109 of 1998 and WAD 6111 of 1998 (First Applications). C. The Applicant in the Ngaanyatjarra Lands Application, each of the Applicants in the First Applications, the State of Western Australia (the State), and the other Respondents to the proceedings (the parties) have reached an agreement as to the terms of the Ngaanyatjarra Lands Determination which is to be made in relation to part of the land and waters covered by the Ngaanyatjarra Lands Application and the First Applications (the Determination Area). D. Pursuant to section 87(1)(a)(ii) and section 87(1)(b) of the Native Title Act 1993 (Cth) (the Act) the parties have filed with this Court an agreement in writing setting out the terms of the agreement reached. E. The terms of the agreement involve the making of consent orders for a determination pursuant to section 87 and 94A of the Act that native title exists in relation to the Determination Area. F. The State has agreed with respect to Reserve 24980 that, but for the partial extinguishment of native title effected by the creation of Reserve 24980, the Applicants in WAD 6004 of 2004 would have held native title rights and interests conferring the right to possession, occupation, use and enjoyment of the land and waters to the exclusion of all others, save in respect of flowing and subterranean water. G. The State has agreed with respect to the areas set out in Schedule 2 of the Minute of Consent Determination of Native Title that, but for the complete extinguishment of native title effected over those areas, the Applicants in WAD 6004 of 2004 would have held native title rights and interests conferring the right to possession, occupation, use and enjoyment of the land and waters to the exclusion of all others, save in respect of flowing and subterranean water. H. The parties acknowledge that the effect of the making of the determination is that the members of the native title claim group, in accordance with the traditional laws acknowledged and the traditional customs observed by them, should be recognised as the native title holders for the Determination Area. I. The parties have requested that the Court hear and determine that part of the proceedings that relates to the Determination Area. J. The Applicants to the proceedings have nominated Yarnangu Ngaanyatjarraku Parna (Aboriginal Corporation) pursuant to section 56(2) of the Act to hold the determined native title in trust for the native title holders. K. The parties have agreed that upon and by force of the Ngaanyatjarra Lands Determination taking effect, the First Applications will be discontinued in relation to the land and waters covered by the Determination, other than WAD 6103 of 1998 in relation to the area of land and waters not covered by the Ngaanyatjarra Lands Determination. BEING SATISFIED that a determination of native title in the terms set out in the attached Minute of Consent Determination of Native Title in respect of application WAD 6004 of 2004 would be within the power of the Court and, it appearing to the Court appropriate to do so, pursuant to section 87 of the Act and by the consent of the parties: THE COURT ORDERS THAT: 1. There be a determination of native title in application WAD 6004 of 2004 in the terms of the Minute of Consent Determination of Native Title dated 29 June 2005 and attached to these orders. 2. The First Applications, other than application WAD 6103 of 1998, be discontinued. 3. Yarnangu Ngaanyatjarraku Parna (Aboriginal Corporation) hold the determined native title in trust for the native title holders pursuant to s56(2) of the Act. 4. There be liberty to any party to apply on 7 days written notice. 5. There be no order as to costs. Note: Settlement and entry of orders is dealt with in Order 36 of the Federal Court Rules. The Court is very grateful to Mr Ward, a senior member of the Peoples, for acting as interpreter for Counsel and for the Court. 3 The area for which the determination is sought covers some 187,000 square kilometres of land and waters in the State of Western Australia. It extends west from the border between Western Australia, South Australia and the Northern Territory. The area includes reserves and special leases granted for the use and benefit of Aboriginal people. It also includes the Gibson Desert Nature Reserve and the Warburton Range Stock Route. 4 The proceeding was commenced by the Ngaanyatjarra Lands Application (the Application), which was filed in the Federal Court of Australia in Perth on 23 April 2004. The parties to that application have now reached an agreement about the terms of an order of the Federal Court of Australia determining native title, and they now ask the Court to make an order in the terms that they have agreed, and to do so without holding a further hearing. 5 Some 2,700 men and women are named in a schedule to the proposed order as those who, with their descendants, are the Peoples of the Ngaanyatjarra Lands. 6 For the reasons that follow, I am satisfied that the Court can, and should, make an order in the terms the parties seek. 7 I should, however, first explain that the same area is the subject of six separate applications for the recognition of native title: WAD 6030 of 1998, WAD 6041 of 1998, WAD 6101 of 1998, WAD 6103 of 1998, WAD 6109 of 1998 and WAD 6111 of 1998. The present application, the Ngaanyatjarra Lands Application, was brought so that instead of there being six applications, there should be just one application for the whole area. The orders that the Court is now asked to make provide for the discontinuance of five of the six applications. The other application, WAD 6103 of 1998, is to remain current because part of its claim area is not covered by the Ngaanyatjarra Lands Application. 8 Section 87 of the Native Title Act 1993 (Cth) (the Act) provides that if the parties reach agreement on the terms of an order of the Federal Court, the Court may "if it appears to it to be appropriate to do so" make an order in those terms without holding a hearing. There are, however, preconditions: the terms of the agreement, in writing, signed by or on behalf of the parties, must first be filed with the Court, and the Court must be satisfied that the order in those terms would be within the power of the Court. 9 The terms of the agreement between the parties are in writing, the agreement is signed by or on behalf of the parties and the agreement is filed with the Court. There can be no doubt about the jurisdiction of the Court to make the order sought (see s 81 of the Act) and there is nothing in the agreed terms that would suggest that the power of the Court would be exceeded. Specifically, the requirements of s 94A of the Act are satisfied because the proposed order sets out details of each of the matters mentioned in s 225. 10 It therefore remains only to consider whether it would be "appropriate" to make the orders sought. 11 The discretion conferred by s 87(1) must of course be exercised judicially and within the broad boundaries ascertained by reference to the subject matter, scope and purpose of the Act. The matters to be taken into account in the exercise of the discretion, and the weight to be given to those matters, may very well vary according to the particular circumstances of each case. 12 In the present case, it is clear that the parties have had independent and competent legal advice and there is no suggestion that the agreement was not freely entered into. The agreed terms of the proposed orders are unambiguous and are appropriate in the circumstances. 13 The Court has been much assisted in understanding the connection of the native title claimant group with their land by the commendably clear and comprehensive way in which the claimant application has been prepared. The uncontested statements in the Application give the Court some understanding of the laws and customs of the Peoples of the Ngaanyatjarra Lands. The application sets out the various matters required by s 62 of the Act, including a general description of the native title rights and interests claimed and the factual basis upon which it is said that the claim group, and their predecessors, had an association with the area. It outlines the basis for the claim that there existed traditional laws and customs that give rise to native title and that the claim group has continued to hold the native title in accordance with those traditional laws and customs. It explains, in outline, but sufficiently for present purposes, the basis of the claim of association with the area. It explains also that the fundamental concept in the belief system of the people of the Western Desert is that of the Tjukkurrpa and it explains in broad outline how that concept relates to the traditional laws and customs that are the foundation of the claim. 14 The traditional laws acknowledged, and the customs observed, by the people, encompass all aspects of their lives, as they have done since they first came to these vast lands long, long ago. It is a connection that can be traced so deep into the lives of the Peoples of the Ngaanyatjarra Lands that it involves spiritual, physical, historical, legal (that is to say, customary legal), economic and social elements. The Application tells, for example, of how the Peoples of the Ngaanyatjarra Lands spiritual connection to their Country can be found in the collective belief that the Tjukurrpa are responsible for the existence and form of the land itself. 15 In the distant past, dreaming beings travelled vast distances across the desert and through the Ngaanyatjarra Lands, creating the waterholes and landscape features and laying down the songs and dances for the people to perform. They include the dance and song, performed last night at the place where the court sits today, about the emu and the turkey, who met up at a place called Yankal-Tjungku to the north of here, and continued on. The Ngaanyatjarra Lands are characterised by the number and richness of these great travelling stories of creation, which still form the backbone of the people's culture and way of life. 16 In these circumstances I am quite satisfied that it would be appropriate to make an order in the terms agreed between the parties. 17 It is always a cause for great satisfaction when native title claims are settled by agreement rather than through litigation. As I said in Anderson on behalf of the Spinifex People v State of Western Australia [2000] FCA 1717, at para 1: "Courts have always encouraged parties to settle their claims amicably. Agreement is especially desirable in native title cases due to the importance, complexity and sensitivity of the issues involved. Agreement between the parties minimises cost and distress and establishes goodwill between the parties for future dealings: North Ganalanja Aboriginal Corporation v Queensland (1996) 185 CLR 595." 18 In this case the efforts of all the parties and their representatives are especially noteworthy. As I have said, the present single application takes the place of six individual claims and the parties have gone ahead with commendable speed to achieve an agreement within little more than a year after the filing of this application. 19 Finally, I should emphasise to all present that the order that the Court will now make determines, under the laws of Australia, that native title exists, as it always has, according to the traditional laws and customs of the Peoples of the Ngaanyatjarra Lands, and that the title is held by those Peoples. The order does not grant native title to the Peoples of the Ngaanyatjarra Lands; it recognises what they have long held. Native title exists in relation to the Determination Area. The Native Title Holders (s225(a)) 2. The native title is held by the persons described in Schedule 3 (native title holders). The nature and extent of native title rights and interests (s225(b) and s225(e)) 3. Subject to paragraphs 5, 6 and 7, the nature and extent of the native title rights and interests held in relation to Reserve 24980 (Warburton Range Stock Route) [being an area where there has been partial extinguishment of native title] are: (a) the right to enter and remain; (b) the right to take fauna and flora; (c) the right to take water for personal, domestic, or non-commercial communal purposes; (d) the right to take other natural resources such as ochre, stones, soils, wood and resin; and (e) the right to care for, maintain and protect from physical harm, particular sites and areas of significance to the native title holders. 4. Subject to paragraphs 5, 6 and 7, the nature and extent of the native title rights and interests in each other part of the Determination Area [being areas where there has been no extinguishment of native title or areas where any extinguishment must be disregarded] are: (a) except in relation to flowing and subterranean water - the right of possession, occupation, use and enjoyment to the exclusion of all others; and (b) the right to take flowing and subterranean water for personal, domestic, or non-commercial communal purposes. 5. The native title rights and interests described in paragraphs 3 and 4(b) do not confer possession, occupation, use and enjoyment on the native title holders to the exclusion of all others. 6. The native title rights and interests are: (a) exercisable in accordance with the traditional laws and customs of the native title holders; and (b) subject to the laws of the State and the Commonwealth including the common law. 7. Notwithstanding anything in this determination the native title rights and interests include the right to take and use ochre to the extent that ochre is not a mineral pursuant to the Mining Act 1904 (WA), but do not include other minerals and petroleum as defined in the Mining Act 1904 (WA), the Mining Act 1978 (WA) as in force at the date of this determination, the Petroleum Act 1936 (WA) and the Petroleum Act 1967 (WA) as in force at the date of this determination. Areas to which ss47A and 47B apply 8. Sections 47A and 47B of the Native Title Act apply to disregard any prior extinguishment in relation to the areas described in Schedule 5. Nature and extent of other rights and interests in relation to the Determination Area (s225(c)) 9. The nature and extent of other rights and interests in relation to the Determination Area are those set out in Schedule 4. Relationship between the native title rights and interests and other interests (s225(d)) 10. The relationship between the native title rights and interests described in paragraphs 3 and 4 and the other interests referred to in paragraph 9 ("the other rights and interests") is that: (a) to the extent that any of the other rights and interests are inconsistent with the continued existence, enjoyment or exercise of the native title rights and interests, the native title rights and interests continue to exist in their entirety, but the native title rights and interests have no effect in relation to the other rights and interests to the extent of the inconsistency during the currency of the other rights and interests; and otherwise, (b) the existence and exercise of the native title rights and interests do not prevent the doing of any activity required or permitted to be done by or under the other rights and interests, and the other rights and interests, and the doing of any activity required or permitted to be done by or under the other rights and interests, prevail over the native title rights and interests and any exercise of the native title rights and interests, but do not extinguish them. Definitions and interpretation 11. In this determination, unless the contrary intention appears: "Determination Area" means the land and waters described in Schedule 1 and depicted on the plans attached to Schedule 1; "flowing and subterranean water" means the following water within the Determination Area: (a) water which flows, whether permanently, intermittently or occasionally, within any river, creek, stream or brook; (b) any natural collection of water into, through, or out of which a river, creek, stream or brook flows; and (c) water from and including an underground water source, including water that percolates from the ground; "land" and "waters" respectively have the same meanings as in the Native Title Act 1993 (Cth); "Native Title Act" means the Native Title Act 1993 (Cth); "water" includes flowing and subterranean water. The interests of WMC Resources Ltd under: (a) an agreement entered into between the Ngaanyatjarra Lands Council (Aboriginal Corporation) and WMC Resources Ltd on 15 July 1997 as amended from time to time and presently constituted by: (i) the deed of agreement between Ngaanyatjarra Lands Council (Aboriginal Corporation) and WMC Resources Ltd of 15 July 1997; (ii) the deed between the Ngaanyatjarra Lands Council (Aboriginal Corporation) and WMC Resources Ltd dated 19 November 2003 and stamped on 3 May 2004; (iii) the deed between the Ngaanyatjarra Land Council (Aboriginal Corporation) and WMC Resources Ltd dated 13 February 2005 and stamped on 8 April 2005; and (iv) the deed between the Ngaanyatjarra Land Council (Aboriginal Corporation) and WMC Resources Ltd entitled "Exploration Agreement Deed of Variation No.4". (b) the Pre-Determination Agreement for Ngaanyatjarra Lands ILUA (No. 1) entered into between WMC Resources Ltd, the State of Western Australia, Ngaanyatjarra Council (Aboriginal Corporation) and the native title holders. (c) the Memorandum of Understanding about Land Access Process affecting Reserves in Ngaanyatjarra Lands Claim Area entered into between Ngaanyatjarra Council (Aboriginal Corporation), Ngaanyatjarra Lands Council (Aboriginal Corporation), WMC Resources Limited and the State of Western Australia. Access to mining interest areas 6. Without limiting the operation of any other paragraph in Schedule 4, but subject to paragraphs 7 and 8 of Schedule 4 - the right of a holder of a mining tenement under the Mining Act 1978 (WA) referred to in paragraphs 3 and 4 of Schedule 4 to use (including by servants, agents and contractors) such portions of existing roads and tracks in the Determination Area as necessary in order to have access to the mining tenement for the purposes of exercising the rights granted by that tenement. 7. Nothing in paragraph 6 of Schedule 4 allows any upgrade, extension, widening or other improvement to a road or track or any work on a road or track other than work done to maintain it in reasonable repair and in order to leave it in substantially the same condition as it was prior to its use pursuant to paragraph 6. 8. The right in paragraph 6 of Schedule 4 is subject to compliance with the laws of the State, including the Aboriginal Affairs Planning Authority Act 1972 (WA) and the terms of any agreement between the holder of a mining tenement referred to in paragraphs 3 and 4 of Schedule 4 and any or all of the Ngaanyatjarra Land Council (Aboriginal Corporation), the Ngaanyatjarra Council (Aboriginal Corporation) and the registered native title claimants for a native title claim group. Telstra 9. The rights and interests of Telstra Corporation Limited: (a) as the owner or operator of telecommunications facilities installed within the Determination Area and as the holder of a carrier licence under the Telecommunications Act 1997 (Cth); (b) created pursuant to the Telecommunications Act 1991 (Cth), the Telecommunications Act 1997 (Cth) and/or approvals from the Ngaanyatjarra Land Council (Aboriginal Corporation) in respect of the following: (i) customer radio terminals and telecommunications cabling; and (ii) sites within Reserve 17614: (A) Bentley Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 127º07'40.49" Latitude 25º46'08.47"; (B) Eliza Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 127º36'08.93'' Latitude 25º53'59.33''; (C) Clianthus Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 128º07'25.87'' Latitude 25º59'13.59''; (D) Edith Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 127º55'56.45'' Latitude 25º19'12.68''; (E) Kathleen Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 128º43'36.09'' Latitude 25º03'35.88''; (F) Rebecca Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 128º52'29.25'' Latitude 24º49'50.78''; (G) Russell Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 128º22'10.94'' Latitude 25º05'37.68''; (H) Walter Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 128º42'44.56'' Latitude 24º33'50.11''; (I) Wingellina Optic Fibre Regenerator and Exchange Site, located at Longitude 128º56'05'' Latitude 26º03'55'', being a square shaped area of 400m2 (20 metres by 20 metres); and (J) Blackstone Telecommunications Radio, Optic Fibre Regenerator and Exchange Site, being a rectangular shaped area of 360m² (18 metres by 20 metres), located at Longitude 128º17'05'' Latitude 25º59'55''; and (iii) sites within Reserve 21471: (K) Mummine Telecommunications Radio Site, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.06 metres from a central station mark located at Longitude 126º44'42.79'' Latitude 26º01'42.08''; (L) Warburton West Telecommunications Radio Site, being a square shaped area of 22,500m² (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 126º28'07.99'' Latitude 26º09'55.69''; (M) Warburton Telephone Exchange, located within Reserve 21471, being a square shaped area of 625m² (25 metres by 25 metres); and (iv) Heather Telecommunications Radio Site, located within Special Purpose Lease 3116/10903, at Milyuga Location 10, being a square shaped area of 22,500m2 (150 metres by 150 metres), the corner points of which are located 106.07 metres from a central station mark located at Longitude 125º51'02.98'' Latitude 26º05'18.71''. (c) created pursuant to the Post and Telegraph Act 1901 (Cth), the Telecommunications Act 1975 (Cth), the Australian Telecommunications Corporation Act 1989 (Cth), the Telecommunications Act 1991 (Cth) and the Telecommunications Act 1997 (Cth); (d) for its employees, agents or contractors to enter the Determination Area in the performance of their duties, to access its telecommunications facilities in, and in the vicinity of, the Determination Area; (e) under a sub-lease of Reserve 21471 dated 30 September 1998 between the Ngaanyatjarra Land Council (Aboriginal Corporation) as lessor and Telstra as lessee; and (f) under a Deed of Agreement entitled "Telstra-Ngaanyatjarra Determination Deed" between Telstra Corporation Ltd, Ngaanyatjarra Land Council (Aboriginal Corporation), Ngaanyatjarra Council (Aboriginal Corporation) and the native title holders. Airservices Australia 10. The rights and interests of Airservices Australia, including: (a) under a Deed of Agreement entitled "Airservices Australia-Ngaanyatjarra Determination Deed" between Airservices Australia, Ngaanyatjarra Land Council (Aboriginal Corporation) and the Native Title Holders; (b) as the owner and operator of radio-communication and navigational facilities at Warburton and Giles; (c) rights and interests created pursuant to the Air Navigation Act 1920 (Cth), the Civil Aviation Act 1988 (Cth) and the Air Services Act 1995 (Cth); and (d) rights of access by employees, agents or contractors of Airservices Australia to the facilities referred to in (b) in the performance of their duties. Bureau of Meteorology 11. The rights and interests of the Bureau of Meteorology including:- (a) as the owner and operator of meteorological facilities situated at the Warburton Airfield on Reserve 21471, namely an automatic weather station, rain gauge and Stevenson screen; and (b) rights of access by employees, agents and contractors of the Bureau of Meteorology to the facilities referred to in (a) in the performance of their duties. Shire of Laverton 12. Rights and interests of the Shire of Laverton pursuant to statute or otherwise in that part of the Determination Area within the boundaries of the Shire including the maintenance of the following roads: (a) Parallel Road; (b) Rawlinna Warburton Road; (c) Ilkurlka Wingelina Road; and (d) Hunt Oil Road. Other 13. The following rights and interests: (a) rights and interests granted by the Crown pursuant to statute or otherwise in the exercise of its executive power; (b) rights or interests held by reason of the force and operation of the laws of the State or of the Commonwealth including the force and operation of the Rights in Water and Irrigation Act 1914 (WA); (c) the right to access the Determination Area by: (i) an employee or agent or instrumentality of the State; (ii) an employee or agent or instrumentality of the Commonwealth; (iii) an employee or agent or instrumentality of any local government authority as required in the performance of his or her statutory or common law duty where such access would be permitted to private land; and (d) the right of any person to use (subject to the laws of the State, in particular the Aboriginal Affairs Planning Authority Act 1972 (WA) and Regulations) the Great Central Road and any road in the Determination Area over which, as at the date of the Determination, the public has a right of way according to the common law. SCHEDULE 5 – AREAS TO WHICH ss47A AND 47B APPLY Section 47A 5. Section 47A of the Native Title Act applies to the following areas within the Determination Area: (a) Reserve 17614 for the purpose of "Use and Benefit of Aboriginal Inhabitants" vested pursuant to section 33 of the Land Act 1933 (WA) in the Aboriginal Lands Trust on 3 August 1973; (b) Reserve 21471 for the purpose of "Use and Benefit of Aboriginal Inhabitants" vested pursuant to section 33 of the Land Act 1933 (WA) in the Aboriginal Lands Trust on 16 November 1973; (c) Reserve 24923 for the purpose of "Use and Benefit of Aboriginal Inhabitants" vested pursuant to section 33 of the Land Act 1933 (WA) in the Aboriginal Lands Trust on 11 November 1988; (d) Reserve 24966 for the purposes of "Use and Benefit of Aboriginal Inhabitants and Meteorological Station" vested pursuant to section 33 of the Land Act 1933 (WA) in the Aboriginal Lands Trust on 13 September 1991; (e) Reserve 29452 for the purpose of "Use and Benefit of Aboriginal Inhabitants" vested pursuant to section 33 of the Land Act 1933 (WA) in the Aboriginal Lands Trust on 11 November 1988; (f) Reserve 40784 for the purpose of "Use and Benefit of Aboriginal Inhabitants" vested pursuant to section 33 of the Land Act 1933 (WA) in the Aboriginal Lands Trust on 11 November 1988; (g) Reserve 40785 for the purpose of "Use and Benefit of Aboriginal Inhabitants" vested pursuant to section 33 of the Land Act 1933 (WA) in the Aboriginal Lands Trust on 11 November 1988; (h) Reserve 40787 for the purpose of "Use and Benefit of Aboriginal Inhabitants" vested pursuant to section 33 of the Land Act 1933 (WA) in the Aboriginal Lands Trust on 11 November 1988; and Section 47B 6. Section 47B of the Native Title Act applies to the areas of unallocated Crown land shown on the plans attached to Schedule 1 within the Determination Area.
