UPON THE APPLICANT BY HIS COUNSEL UNDERTAKING TO THE COURT: 1. To disclaim any possessory lien in respect of bankrupt estate files and funds in trust held by him or under his control in respect of the administrations; 2. To make available by 2 pm on Tuesday 12 July 2011, for collection by the Official Trustee all files and funds in respect of the administrations and otherwise cooperate with and assist the Official Trustee as reasonably required and at no cost to him, in assuming the conduct of the administrations; and 3. To cease carrying out, consenting to or otherwise accepting appointment as a registered trustee under the Bankruptcy Act 1966 (Cth) (the Act) until such times as he has produced evidence in a form acceptable to the Inspector-General in Bankruptcy, a committee formed pursuant to Division 1 of Part VIII of the Act or to the Court demonstrating his practical and financial capacity adequately and properly to carry out his duties as a registered trustee. THE COURT ORDERS CONSENT THAT: 1. Pursuant to section 180 of the Act, the Court accepts the resignation of the Applicant from the office of trustee of each of the bankrupt estates listed in Annexure "A" hereto. Note: Settlement and entry of orders is dealt with in Order 36 of the Federal Court Rules. The text of entered orders can be located using Federal Law Search on the Court's website.
