An Act to amend the Trade Practices Act 1974, and for related purposes

The Parliament of Australia enacts:
1 Short title
This Act may be cited as the Trade Practices Amendment (Access Declarations) Act 2008.
2 Commencement
This Act commences on the day on which it receives the Royal Assent.
3 Schedule(s)
Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
Schedule 1—Amendments
Trade Practices Act 1974
1 At the end of section 152AL Add:
Declaration is not a legislative instrument
(9) A declaration under this section is not, and is taken never to have been, a legislative instrument for the purposes of the Legislative Instruments Act 2003.
(10) A variation of a declaration made under this section is not, and is taken never to have been, a legislative instrument for the purposes of the Legislative Instruments Act 2003.
(11) A revocation of a declaration made under this section is not, and is taken never to have been, a legislative instrument for the purposes of the Legislative Instruments Act 2003.
(12) If: (a) a declaration was made under this section before the commencement of this subsection; and (b) the declaration ceased to be in force before the commencement of this subsection; then: (c) the declaration is taken never to have been a legislative instrument for the purposes of the Legislative Instruments Act 2003; and (d) if the declaration was varied or revoked before the commencement of this subsection—the variation or revocation is taken never to have been a legislative instrument for the purposes of the Legislative Instruments Act 2003.
