An Act to amend the Education Services for Overseas Students Act 2000, and for related purposes

The Parliament of Australia enacts:

1 Short title This Act may be cited as the Education Services for Overseas Students Amendment (Re‑registration of Providers and Other Measures) Act 2010.

2 Commencement This Act commences on the day this Act receives the Royal Assent.

3 Schedule(s) Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Re‑registration etc. of providers

Part 1—Amendments

Education Services for Overseas Students Act 2000

1 Paragraph 4B(2)(b) Repeal the paragraph, substitute: (b) paragraph 9B(1)(a);

2 Section 5 Insert: higher education provider has the same meaning as in the Higher Education Support Act 2003.

3 Section 5 (at the end of the definition of registered) Add ", and (except in sections 9 to 9B) includes re‑registered under section 9A".

4 Subparagraph 9(2)(b)(ii) Repeal the subparagraph, substitute: (ii) the provider would be exempt under subsection 24(2) from paying annual Fund contributions if the provider were a registered provider; and
