An Act to amend the law relating to telecommunications interception and access, and the sharing of information and things, and for related purposes

The Parliament of Australia enacts:

1 Short title This Act may be cited as the Telecommunications Interception and Other Legislation Amendment (State Bodies) Act 2012.

2 Commencement (1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1, items 29 and 30 The later of: 28 June 2012 (a) the day after this Act receives the Royal Assent; and (paragraph (a) applies) (b) the day the Independent Broad‑based Anti‑corruption Commission Amendment (Investigative Functions) Act 2012 of Victoria receives the Royal Assent. However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur. 4. Schedule 1, items 31 to 36 The later of: 10 February 2013 (a) the day after this Act receives the Royal Assent; and (see Vict. Gazette No. S32) (b) the day section 16 of the Independent Broad‑based Anti‑corruption Commission Amendment (Investigative Functions) Act 2012 of Victoria commences. (paragraph (b) applies) However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur. 5. Schedule 1, item 37 The later of: 28 June 2012 (a) the day after this Act receives the Royal Assent; and (paragraph (a) applies) (b) the day the Independent Broad‑based Anti‑corruption Commission Amendment (Investigative Functions) Act 2012 of Victoria receives the Royal Assent. However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur. 6. Schedule 1, items 38 to 40 The latest of: 10 February 2013 (a) the day after this Act receives the Royal Assent; and (see Vict. Gazette No. S32) (b) the day Schedule 1 to the Cybercrime Legislation Amendment Act 2012 commences; and (paragraph (c) applies) (c) the day section 16 of the Independent Broad‑based Anti‑corruption Commission Amendment (Investigative Functions) Act 2012 of Victoria commences. However, the provision(s) do not commence at all if the event mentioned in paragraph (b) or (c) does not occur. 7. Schedule 1, item 41 The latest of: 10 October 2012 (a) the day after this Act receives the Royal Assent; and (paragraph (b) applies) (b) the day Schedule 1 to the Cybercrime Legislation Amendment Act 2012 commences; and (c) the day the Independent Broad‑based Anti‑corruption Commission Amendment (Investigative Functions) Act 2012 of Victoria receives the Royal Assent. However, the provision(s) do not commence at all if the event mentioned in paragraph (b) or (c) does not occur. 8. Schedule 1, item 42 The later of: 10 February 2013 (a) the day after this Act receives the Royal Assent; and (see Vict. Gazette No. S32) (b) the day section 16 of the Independent Broad‑based Anti‑corruption Commission Amendment (Investigative Functions) Act 2012 of Victoria commences. (paragraph (b) applies) However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur. 9. Schedule 2 Immediately after the commencement of the provision(s) covered by table item 2. 10 February 2013 10. Schedule 3 The later of: 10 February 2013 (a) the day after this Act receives the Royal Assent; and (see Vict. Gazette No. S32) (b) the day Part 7 of the Public Interest Monitor Act 2011 of Victoria commences. (paragraph (b) applies) However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur. 11. Schedule 4 The later of: 20 December 2012 (a) the day after this Act receives the Royal Assent; and (see South Australia Gazette 20 December 2012 p5742) (b) the day the Independent Commissioner Against Corruption Act 2012 of South Australia commences. (paragraph (b) applies) However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur.
