An Act to amend the Antarctic Treaty (Environment Protection) Act 1980, and for other purposes

The Parliament of Australia enacts:
1 Short title This Act may be cited as the Antarctic Treaty (Environment Protection) Amendment Act 2012.
2 Commencement (1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1, Part 1 The earlier of: (a) a single day to be fixed by Proclamation; and (b) the day Measure 4 (2004), adopted by the XXVIIth Antarctic Treaty Consultative Meeting at Cape Town on 4 June 2004, comes into force for Australia. The Minister must announce by notice in the Gazette the day the Measure comes into force for Australia. 3. Schedule 1, Parts 2 and 3 The later of: (a) immediately after the commencement of the provision(s) covered by table item 9; and (b) immediately after Measure 4 (2004), adopted by the XXVIIth Antarctic Treaty Consultative Meeting at Cape Town on 4 June 2004, comes into force for Australia. However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur. The Minister must announce by notice in the Gazette the day the Measure comes into force for Australia. 4. Schedule 2, Part 1 The earlier of: (a) a single day to be fixed by Proclamation; and (b) the day Annex VI to the Madrid Protocol, attached to Measure 1 (2005) adopted by the XXVIIIth Antarctic Treaty Consultative Meeting at Stockholm on 17 June 2005, comes into force for Australia. The Minister must announce by notice in the Gazette the day the Annex comes into force for Australia. 5. Schedule 2, Part 2 The later of: (a) immediately after the commencement of the provision(s) covered by table item 9; and (b) immediately after Annex VI to the Madrid Protocol, attached to Measure 1 (2005) adopted by the XXVIIIth Antarctic Treaty Consultative Meeting at Stockholm on 17 June 2005, comes into force for Australia. However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur. The Minister must announce by notice in the Gazette the day the Annex comes into force for Australia. 6. Schedule 2, Part 3 The later of: (a) immediately after the commencement of the provision(s) covered by table item 3; and (b) the start of the day Annex VI to the Madrid Protocol, attached to Measure 1 (2005) adopted by the XXVIIIth Antarctic Treaty Consultative Meeting at Stockholm on 17 June 2005, comes into force for Australia. However, the provision(s) do not commence at all unless both of the events mentioned in paragraphs (a) and (b) occur. The Minister must announce by notice in the Gazette the day the Annex comes into force for Australia. 7. Schedule 2, Part 4 At the same time as the provision(s) covered by table item 5. 8. Schedule 3 The later of: (a) the day after this Act receives the Royal Assent; and (b) the day Measure 15 (2009), adopted by the XXXIInd Antarctic Treaty Consultative Meeting at Baltimore on 17 April 2009, comes into force for Australia. However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur. The Minister must announce by notice in the Gazette the day the Measure comes into force for Australia. 9. Schedule 4 The day after this Act receives the Royal Assent. 29 June 2012
