Radiocommunications (Spectrum Re‑allocation—Regional 1800 MHz Band) Declaration 2015
I, MALCOLM BLIGH TURNBULL, Minister for Communications, having had regard to a recommendation given to me by the Australian Communications and Media Authority under subsection 153F(1) of the Radiocommunications Act 1992, make the following declaration under subsection 153B(1) of that Act.

1 Name of declaration This declaration is the Radiocommunications (Spectrum Re-allocation—Regional 1800 MHz Band) Declaration 2015.
2 Commencement This declaration commences on the day after it is registered on the Federal Register of Legislative Instruments.
3 Interpretation (1) In this declaration: Act means the Radiocommunications Act 1992. regional Australia means the areas specified in the table of clause 1 of Schedule 1. Note: A number of expressions used in this instrument are defined in the Act, including the following: (a) re-allocation deadline; (b) re-allocation period; (c) spectrum; (d) spectrum licence. (2) In this declaration, a reference to a part of the spectrum includes all frequencies that are greater than the lower frequency, up to and including the higher frequency. Note: This means the lower number in the reference to a part of the spectrum is not included in the part of the spectrum.
4 Spectrum re-allocation (1) The following parts of the spectrum are subject to re-allocation under Part 3.6 of the Act in relation to the re-allocation period: (a) 1725 MHz to 1785 MHz; and (b) 1820 MHz to 1880 MHz. (2) For both parts of the spectrum, this declaration applies with respect to regional Australia. (3) Each part of the spectrum should be re-allocated by issuing spectrum licences under Subdivision B of Division 1 of Part 3.2 of the Act (see section 153L). (4) The re-allocation period for this declaration is the period of 2 years beginning on the day this declaration commences. (5) The re-allocation deadline for this declaration is the day before the first anniversary of the commencement of this declaration.
