1 Name of Order This Order is Marine Order 17 (Chemical tankers and gas carriers) 2016.

1A Commencement This Order commences on 1 January 2017.

1B Repeal of Marine Order 17 (Liquefied gas carriers and chemical tankers) 2006 Marine Order 17 (Liquefied gas carriers and chemical tankers) 2006 is repealed.

2 Purpose This Order: (a) gives effect to Parts B and C of Chapter VII of SOLAS dealing with the certification of vessels carrying dangerous liquid chemicals and liquefied gases in bulk as evidence of survey; and (b) provides for the safe operation of chemical tankers and gas carriers.

3 Power (1)The following provisions of the Navigation Act provide for this Order to be made: (a) section 98 which provides that regulations may be made about safety certificates; (b) subsection 112(5) which provides that regulations may provide for the loading, stowing or carriage of cargo in vessels, the unloading of cargo from vessels, and the giving of notices for the loading, or unloading, stowage or carriage, of cargo into vessels; (c) section 314 which provides that regulations may be made about particular matters relating to certificates; (d) paragraph 340(1)(a) which provides for regulations to give effect to SOLAS; (e) subsection 341(1) which provides that the regulations may impose penalties for a contravention of a provision of the regulations including the imposition of civil penalties. (2)Subsection 339(1) of the Navigation Act provides for regulations to be made prescribing matters required or permitted to be prescribed, or that are necessary or convenient to be prescribed, for carrying out or giving effect to the Act. (3)Subsection 342(1) of the Navigation Act provides that AMSA may make a Marine Order about matters that can be provided for by regulation.
