Telecommunications (Interception and Access — Law Enforcement Conduct Commission of New South Wales) Declaration 2017 Telecommunications (Interception and Access) Act 1979

I, George Brandis QC, Attorney-General, being satisfied that: (a) the law of the State of New South Wales makes satisfactory provision for the matters mentioned in subsection 35(1) of the Telecommunications (Interception and Access) Act 1979; and (b) the State of New South Wales has entered into an agreement as required by subsection 35(2) of that Act; make the following declaration under section 34 of that Act, at the request of the Premier of the State of New South Wales.

1 Name of declaration This declaration is the Telecommunications (Interception and Access — Law Enforcement Conduct Commission of New South Wales) Declaration 2017. 2 Commencement (1) This declaration commences on the later of: (a) the start of the day this declaration is registered; and (b) the day Item 4, Division 1, Part 2 of Schedule 1 of the Law Enforcement Legislation Amendment (State Bodies and Other Measures) Act 2016 commences. (2) However, this declaration does not commence at all if the event mentioned in paragraph (b) does not occur. 3 Declaration of agency The Law Enforcement Conduct Commission that is established by the Law Enforcement Conduct Commission Act 2016 of New South Wales is declared to be an agency for the purposes of the Telecommunications (Interception and Access) Act 1979.

4 Revocation

(1) The Telecommunications (Interception) Act 1979 - Agency (Police Integrity Commission) Declaration 1998 (Federal Register of Legislative Instruments No. F2009B00190) is revoked. (2) This section expires at the end of the day on which this section commences as if this section had been repealed by another legislative instrument.
