Information may be inserted in this column, or information in it may be edited, in any published version of this instrument. 3 Authority This instrument is made under subsection 23DF(13) of the Health Insurance Act 1973. 4 Definitions In this instrument: ACN has the meaning given by section 9 of the Corporations Act 2001. Act means the Health Insurance Act1973. Note: A number of expressions used in this instrument are defined in section 3(1) of the Act, including the following: (a) ABN; (b) approved pathology authority; (c) proprietor. 5 Determination of particulars (1) For the purposes of paragraph 23DF(2)(c) of the Health Insurance Act 1973, an application under subsection 23DF(1) of that Act must contain the particulars as specified in Schedule 1. 6 Schedules Each instrument that is specified in Schedule 2 to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms. Schedule 1—Particulars for Application for Acceptance of Approved Pathology Authority Undertaking (Section 5) 1 Application type (1) Whether the application is: (a) for a new approved pathology authority undertaking; or (b) to renew or update the details of an existing pathology authority undertaking. 2 Applicant's details (1) Approved pathology authority number (for renewals or amendments only). (2) Approved pathology authority name. (3) Registered address. (4) Address for correspondence. 3 Authorised representative details (1) Authorised representative's name. (2) Authorised representative's day time phone number. (3) Authorised representative's mobile number. (4) Authorised representative's fax number. (5) Authorised representative's email address. 4 Proprietor details (1) ABN of the proprietor. (2) ACN of the proprietor. (3) Registered trading name if any (must be owned by the applicant). (4) Date trading name registration expires. (5) Whether the proprietor is: (a) an individual; or (b) a partnership; or (c) a company; or (d) a government agency or public body. 5 Individual details (1) If the proprietor is an individual, the full name of the individual. 6 Partnership (1) If the proprietor is a partnership, the following details of each partner within the partnership: (a) name of individual or company; (b) individual or company's percentage share of the partnership; (c) ABN; and (d) ACN. 7 Company (1) If the proprietor is a company, the following details of the company: (a) registered business name; (b) ACN; (c) names of all the directors; (d) names of each of the principal shareholders on the date of application in order of shareholding; and (e) approximate percentage of shareholding of each of the principal shareholders. 8 Government agency or public body details (1) If the proprietor is a government agency or public body, the following details of the agency or body: (a) registered business name; and (b) ACN. 9 Principal officers details (1) Names and positions of principal officers of the proprietor. 10 Fit and proper person details (1) Whether the applicant, or any person with whom the applicant has, or proposes to have, a financial, employee/employer or business relationship, is a person: (a) to whom notice has been given under subsection 23DL(1) of the Act or in relation to whom notice has been given to a chairperson of a Medicare Participation Review Committee under subsections 23DL(4) or 124D of the Act; or (b) to whom notice has been given under subsection 124FA(3) or 124FE(3) of the Act; or (c) in relation to whom a Medicare Participation Review Committee has made a determination under section 124F, 124FB, 124FC or 124FF of the Act; or (d) to whom notice has been given under subsection 102(1) of the Act; or (e) to whom a final determination under section 106TA of the Act has been made; or (f) who has been convicted of a relevant offence as defined in section 23DA of the Act. (2) If the applicant discloses a relationship with a person to whom subsection (1) applies, the name, company name and provider number of the person. 11 Additional information (1) Any additional information to support the application.
