DETERMINATION PROHIBITING USE OF VESSELS

CARTIER ISLAND MARINE PARK AND PART OF THE ASHMORE REEF MARINE PARK

I, JASON MUNDY, Acting Director of National Parks, under subregulation 12.56(2) of the Environment Protection and Biodiversity Conservation Regulations 2000, HEREBY DETERMINE that each of the following areas:

1. Cartier Island Marine Park, being the area specified in the Schedule 1 hereto; and

2. the Sanctuary Zone of Ashmore Reef Marine Park, being the area specified in Schedule 2 and shown on the maps in Schedule 3 hereto,

is an area of water where the use of vessels is prohibited at all times, except for vessels of the Commonwealth of Australia and its agents:

AND I HEREBY REVOKE:

1. the determination made on 14 December 2013 prohibiting use of vessels in Cartier Island Marine Park, notified in the Gazette (C2013G01947) and published on 19 December 2013; and

2. the determination made on 14 December 2013 prohibiting the use of vessels in Ashmore Reef Marine Park, notified in the Gazette (C2013G01945) and published on 19 December 2013.

SCHEDULE 1

Cartier Island Marine Park

All the area of land and Australian coastal sea enclosed within the circumference of a circle of radius 4 nautical miles, the centre of which is on an island in the Indian Ocean known as Cartier Island at latitude 12°31'50.8" South and longitude 123°33' 18.8" East.

Note: All geographic coordinates are expressed in terms of the Geocentric Datum of Australia 1994 (GDA94) as described in the Commonwealth of Australia Gazette GN35 of 6 September 1995.

Ashmore Reef Marine Park Sanctuary Zone (IUCN 1a)

All that part of Ashmore Reef Marine Park being outside the area bounded by the line: (a) commencing at the point of Latitude 12° 09′ 55″ South, Longitude 123° 00′ 04.5″ East;
