1 Name This instrument is the Defence (Individual Benefits) Determination 2021 (No. 5). 2 Commencement This instrument commences on the day after it is registered. 3 Authority This instrument is made under section 58B of the Defence Act 1903. 4 Definitions In this Determination, the following apply. Defence Determination means Defence Determination 2016/19, Conditions of service, as in force from time to time. Member means the member of the Australian Defence Force who holds the employee identification number 8119126. Partner has the same meaning given in the Defence Determination at section 1.3.88. 5 PCR testing 1. The member is eligible to be reimbursed the costs of a Polymerase Chain Reaction (PCR) test for the following people a. The member. b. The member's partner if they return to Australia with the member. 2. For the purpose of subsection 1, the Polymerase Chain Reaction (PCR) test must meet the following. a. Be collected in Germany. b. Be for the purpose of detecting the COVID-19 virus. c. Be necessary for the purpose of taking international flights between Germany and Australia. 6 International transport 1. The member is eligible for one of the following for persons listed in subsection 2. a. Subject to subsection 3, reimbursement of the costs of flights from Frankfurt am Main, Germany, via Singapore to Sydney, Australia. b. If flights purchased by the member are cancelled, return travel from Germany to Australia at the class of travel the member would be eligible for under section 13.2.6 of the Defence Determination. 2. Benefits provided in subsection 1 may be provided for any of the following persons. a. The member. b. The member's partner if they return to Australia with the member. 3. For the purpose of subsection 1.a, the flights to be reimbursed must not be taken at a class higher than the member would be eligible for under section 13.2.6 of the Defence Determination. 4. Reimbursement under paragraph 1.a is not payable to the member until the member is in their posting location in Australia. 7 Excess baggage 1. The member is eligible to be reimbursed the costs of excess baggage for the following people. a. The member. b. The member's partner if they return to Australia with the member. 2. For the purpose of subsection 1, the member is not eligible for the costs of excess baggage that exceed of the following. a. If the member and their partner return to Australia — a total weight of 120kg. b. If only the member returns to Australia — a total weight of 60kg. 3. Reimbursement under subsection 1 is not payable to the member until the member is in their posting location in Australia. 8 Transit Accommodation and meals 1. The member is eligible for transit accommodation and meals in a transit location for the following people. a. The member. b. The member's partner if they return to Australia with the member. 2. For the purpose of subsection 1, the accommodation must be undertaken between the member's arrival in a transit location and the member's flight from a transit location to Australia. 3. In this section, transit accommodation and meals means the amount payable for accommodation, meals and incidentals under section 13.3.6 of the Defence Determination, as modified by the flowing. a. Section 13.3.9 of the Defence Determination. b. Section 13.3.10 of the Defence Determination.
