Comptroller (Operational Safety) Directions 2021

I, Michael Outram, Comptroller of the Indian Ocean Territories Customs Service, under subsection 189A(2) of the Customs Act 1901(C.I.) and subsection 189A(2) of the Customs Act 1901 (C.K.I.), make this instrument.

1 Name This instrument is the Comptroller (Operational Safety) Directions 2021.

2 Commencement This instrument commences on the day after this instrument is registered.

3 Authority This instrument is made under subsection 189A(2) of the C.K.I. Act and subsection 189A(2) of the C.I. Act.

4 Definitions Note: A number of expressions used in this instrument are defined in the C.K.I. Act and C.I. Act, including the following: (a) approved firearm; (b) approved item of personal defence equipment; (c) authorised arms issuing officer; (d) officer authorised to carry arms. In this instrument: C.K.I. Act means the Customs Act 1901 (C.K.I.). C.I. Act means Customs Act 1901 (C.I.). officer of Customs means: (a) an officer of Customs within the meaning of the C.K.I. Act; or (b) an officer of Customs within the meaning of the C.I. Act.

5 Directions The following directions are given in relation to the deployment of approved firearms and other approved items of personal defence equipment: (a) An authorised arms issuing officer must ensure that an officer authorised to carry arms to whom approved firearms or approved items of personal defence equipment (other than anti-ballistic clothing) are issued is the holder of a valid and current Use of Force Permit, qualification or appointment in accordance with the Operational Safety Order (2021). (b) An officer authorised to carry arms must not seek to be issued with approved firearms or approved items of personal defence equipment (other than anti-ballistic clothing) unless they satisfy all of the fitness for duty and training requirements and are the holder of a valid and current Use of Force Permit, qualification or appointment in accordance with the Operational Safety Order (2021). (c) Approved firearms and approved items of personal defence equipment must be deployed, used and returned in accordance with the Operational Safety Order (2021). (d) Approved firearms and approved items of personal defence equipment must be stored in accordance with the Operational Safety Order (2021). (e) An officer of Customs may only use force in accordance with the Operational Safety Order (2021).
