1 Name This instrument is the Seafarers Rehabilitation and Compensation Act 1992 – Guide to the Assessment of the Degree of Permanent Impairment Edition 3.0.
2 Commencement This instrument commences on 1 April 2023 (the commencement date).
3 Authority This instrument is made under section 42 of the Seafarers Rehabilitation and Compensation Act 1992.
4 Definitions Note: A number of expressions used in this instrument are defined in the Seafarers Act, including the following: (a) aggravation (subsection 3(1)); (b) ailment (subsection 6(1)); (c) Authority (subsection 3(1)); (d) determination (subsection 76(1)); (e) employee (section 4); (f) impairment (subsection 3(1)); (g) non-economic loss (subsection 3(1)); (h) permanent (subsection 3(1)); (i) reviewable decision (subsection 76(1)). In this instrument: Activities of daily living has the meaning given in the approved Guide. AMA4 has the meaning given in the approved Guide. AMA5 has the meaning given in the approved Guide. approved Guide means the Guide to the Assessment of the Degree of Permanent Impairment Edition 3.0 set out in Schedule 1 to this instrument. assessor has the meaning given in the approved Guide. binaural hearing loss has the meaning given in the approved Guide. commencement date has the meaning given in section 2 of this instrument. disease has the meaning given in the approved Guide. employer, in relation to an employee, has the same meaning as in the Seafarers Act (see also subsection 4(3) of that Act). injury has the same meaning as in the Seafarers Act (see subsection 3(1) and sections 6 and 7 of that Act) and the TPCA Act (see sections 6 and 7 of that Act). loss of amenities has the meaning given in the approved Guide. medical treatment has the meaning given in the approved Guide. pain has the meaning given in the approved Guide. repealed Guide has the meaning given in section 7 of this instrument. Seafarers Act means the Seafarers Rehabilitation and Compensation Act 1992. suffering has the meaning given in the approved Guide. TPCA Act means the Seafarers Rehabilitation and Compensation (Transitional Provisions and Consequential Amendments) Act 1992.
