Radiocommunications (Area-Wide Licences – Limits, Authorisations and Transfers) Determination 2024
The Australian Communications and Media Authority makes the following determination under subsections 102G(1), 115(1) and 131AC(1) of the Radiocommunications Act 1992.

1 Name This is the Radiocommunications (Area-Wide Licences – Limits, Authorisations and Transfers) Determination 2024.
2 Commencement This instrument commences at the start of the day after the day it is registered. Note: The Federal Register of Legislation is available, free of charge, at www.legislation.gov.au.
3 Authority This instrument is made under subsections 102G(1), 115(1) and 131AC(1) of the Act.
4 Interpretation (1) In this instrument, unless the contrary intention appears: 3.4 GHz band means the part of the spectrum from 3.4 GHz to 3.95 GHz. 3.8 GHz band means the part of the spectrum from 3.8 GHz to 3.95 GHz. Act means the Radiocommunications Act 1992. area-wide licence has the same meaning as in: (a) the Radiocommunications (Interpretation) Determination 2015; or (b) if another instrument replaces that determination and defines the term – the other instrument. Note 1: The Radiocommunications (Interpretation) Determination 2015 is registered on the Federal Register of Legislation and is accessible, free of charge, at www.legislation.gov.au. Note 2: An area-wide licence is a type of transmitter licence determined under section 98 of the Act. associate: see subsection (2). extended 3.8 GHz band means the part of the spectrum from 3.75 GHz to 3.95 GHz. foreign company has the same meaning as in the Corporations Act 2001. local agent has the same meaning as in the Corporations Act 2001. metropolitan area: see Schedule 3. named person means each of the following: (a) Mobile JV Pty Limited (ACN 628 500 916); (b) NBN Co Limited (ACN 136 533 741); (c) Optus Mobile Pty Limited (ACN 054 365 696); (d) Telstra Limited (ACN 086 174 781). regional area: see Schedule 3. related body corporate has the same meaning as in the Corporations Act 2001. relevant area-wide licence means an area-wide licence that authorises the operation of radiocommunications transmitters: (a) in any part of the metropolitan area, on any frequencies in the 3.8 GHz band; or (b) in any part of the regional area, on any frequencies in the 3.8 GHz band; or (c) in any part of the rural area, on any frequencies in the extended 3.8 GHz band. rural area: see Schedule 3. Note: A number of other expressions used in this instrument are defined in the Act, including the following: (a) class licence; (b) spectrum licence; (c) radiocommunications transmitter; (d) receiver licence; (e) transmitter licence. (2) Each of the following is an associate of a named person: (a) a related body corporate of the named person; (b) a director or secretary of the named person; (c) a foreign company for which the named person is a local agent. (3) In this instrument, unless the contrary intention appears, a reference to a part of the spectrum includes all frequencies that are greater than but not including the lower frequency, up to and including the higher frequency.
