The applicant moves the court for an order that a writ of certiorari issue to remove into this court the decision made on behalf of the Public Service Board of the Commonwealth to retire him from the Public Service on the ground of invalidity.

We have heard the applicant's submissions on the assumption that this court can grant certiorari and that a decision of the Public Service Board or of the person who made the decision to retire the applicant are of a kind which are capable of being the subject of certiorari.

The court does not propose to examine the validity of these assumptions in this case, as it is clearly of opinion that even if they were valid, no ground has been shown by the applicant for the grant of such a writ.

We have had an opportunity of considering all the documents which have been put before us, and of considering the applicant's argument in support of his application. There is no need, however, in our opinion, to recite the facts and circumstances of the applicant's employment, service and retirement so far as they appear in the papers before us. I% suffices, in our opinion, to say that none of the three grounds wnich the applicant puts forward as indicative of an excess of

jurisdiction or of error on the face of the proceedings is valid.

Upon the material before the court there was, in our opinion, no irregularity or breach of the statutory provisions regulating the applicant's employment in the Public Service or in the decision to retire him from that service. The application for writ of certiorari must
