In my opinion this application should be refused, I think that some of the criticism which counsel
for the applicant has made of the Court of Criminal Appeal is either misconceived or unfounded. I think that the Court of Criminal' Appeal has not, in any respect, failed to exercise its jurisdiction ~- the jurisdiction vested in it by the statute - and that the application is not one this Court should grant. In my opinion we should not interfere.

In my opinion the whole of the criticism directed against the Court of Criminal Appeal, intemperate as it was, was completely without foundation and should never have been uttered. I agree that the application should be refused. -
