There are before us an appeal and an
application for special leave to appeal from an order of
the Full Court of the Supreme Court of Queensland.
We are of the opinion that, as is virtually
conceded, the appeal does not lie without special leave,
and we have considered whether such leave should be
granted. We are of opinion that there is no substance in
any of the contentions put forward by Mr. Aickin, and
accordingly the application will be refused with costs.
The appeal also will be dismissed with
costs, on the ground that it is incompetent.
