The Court is of opinion in this case that there was no evidence of contributory negligence on the part of the deceased Santucci fit to be submitted to the jury. The Court also sees no reason for disturbing the apportionment of the damages which was made by the jury.
Accordingly the appeal will be dismissed with costs.
