No. 19 (substantially re-enacted by the Markets Act 1890) after pro- viding for the appointment of Commissioners of markets, by sec. 23 (sec. 25 of the Markets Act 1890) authorized the Commissioners to establish in certain towns markets, which should be the only places in those towns where certain goods should be sold, and enacted that any person who should sell any of those goods elsewhere than in the market places so established (except in his dwell- ing-house or shop), should on convietion before a justice be liable toa penalty. 6 Vict. No. 7, which established the corporation of the Town of Melbourne and the Council thereof, by sec. 71 conferred on the Council 'the same powers authorities duties and immunities in respect of markets" as by 8 Vict.
