(3) The appeal is upheld. (4) The DA for the construction of a two-storey boarding house with eleven (11) boarding rooms and four (4) at grade car parking spaces and associated landscaping at 36 Jamison Road, Kingswood (legally known as Lot 20 in Deposited Plan 209236) is approved subject to the conditions set out in Annexure 'A'. (5) The Applicant is to pay the Respondent's costs thrown away as a result of the amendment, pursuant to section 8.15(3) of the Environmental Planning and Assessment Act 1979, in the amount of $7,600.00.
