(2) Pursuant to s 8.15(3) of the Environmental Planning and Assessment Act 1979, the Applicant is to pay the Respondent's costs thrown away as a result of amending the Application, in the agreed amount of $4,750 within 30 days of the date of these orders. (3) The Applicant's written request pursuant to clause 4.6 of the Randwick Local Environmental Plan 2012, seeking a variation to the development standard for height of building, is upheld. (4) The appeal is upheld. (5) Consent is granted to Development Application No. DA 220/2021 for the demolition of three existing buildings and associated structures, and the construction of a four-storey boarding house development at 19-23 Mulwarree Avenue, Randwick, subject to the conditions contained in Annexure A. (6) The exhibits, other than 2, 3, N and Y, are returned.
