Under s 149C(4)(a) of the Health Practitioner Regulation National Law (NSW), if Ms Menchin was still registered as a nurse, the Tribunal would have suspended her registration for a period of 4 months from the date of this decision. 2. Under s 149C(4)(c) of the National Law, the Tribunal requires the Nursing and Midwifery Board to record the fact that had Ms Menchin been registered, the Tribunal would have suspended her registration for a period of 4 months from the date of this decision. 3. Ms Menchin is to pay the costs of the Health Care Complaints Commission as agreed or, failing agreement, as assessed under the Legal Profession Uniform Law Application Act 2014 (NSW). 4. The disclosure of the name of Patient A which is set out in the Schedule to the complaint is prohibited under s 64(1)(a) of the Civil and Administrative Tribunal Act 2013 (NSW).
