(3) The Applicant's amended written request under cl 4.6 of the Mosman Local Environmental Plan 2012 (MLEP) prepared by Boston Blyth Fleming and dated 25 November 2022, seeking a variation of the development standard for height under clause 4.3 of the MLEP, is upheld. (4) The Respondent is directed to register the development consent on the NSW planning portal in accordance with section 4.20(1) of the Environmental Planning and Assessment Act 1979 (the EPA Act) within 14 days of the date of these orders. (5) The Applicant is to pay the Respondent's costs thrown away by the amendment of the development application pursuant to section 8.15(3) of the EPA Act, in the agreed amount of $33,000.
