(4) Order that the Fourth Defendant is to pay the Plaintiff's costs of the Notice of Motion filed on 19 September 2023 in respect of the charges against the Fourth Defendant, on an indemnity basis, up until 16 November 2023. (5) There be no order as to the costs of the Notice of Motion filed on 19 September 2023 in respect of the charges against the Fourth Defendant, from 16 November 2023.
