(4) The Applicant is to pay the Respondent the sum of $10,000.00 within 28 days from the date of these orders being made in full satisfaction of the following: (a) The costs thrown away as a result of the amendment of the application for development consent pursuant to s 8.15(3) of the Environmental Planning and Assessment Act 1979; and (b) In satisfaction of the costs payable pursuant to order 6 of the Amended Notice of Motion filed on 13 December, 2023 and made by the Court on 13 December, 2023.
