DECISION 1. On 11 November 2024, the Department of Education (the Department) filed an application by consent seeking to have the Industrial Relations Commission (the Commission) make a new award pursuant to s 10 of the Industrial Relations Act 1996 (NSW) (IR Act). It is to have a three-year term ending on 8 October 2027 and is to be known as Crown Employees (Teachers in Schools and Related Employees) Salaries and Conditions Award 2024 (the Award). The application sought, as a consequence, that the Commission rescind two existing awards pursuant to s 17 of the IR Act. The first of those awards is known as the Crown Employees (Teachers in Schools and Related Employees) Salaries and Conditions Award 2022 (the 2022 Award). The second of those awards is known as the Crown Employees (Chief Education Officers – Department of Education) Salaries and Conditions Award 2021 (The Chief Education Officers' Award). The respondent to the application is the Australian Education Union New South Wales Teachers Federation Branch (NSW Teachers Federation). 2. Following the hearing before me on 20 November 2024, the Department filed an amended application attaching an amended form of the proposed Award as Schedule A.
