In relation to the BIC Appeal, proceedings number 2024/292416, the Court orders: (1) The appeal is upheld. (2) The applicant is directed to carry out the works within the time frames described in the Modified Development Control Order No 5 at Annexure A. (3) The respondent is directed pursuant to s 8.25(3) of the Environmental Planning and Assessment Act 1979 to issue a Building Information Certificate with respect to the retaining wall identified as Attachment A to the Modified Development Control Order within 7 days of receiving the certification required in Order 6 of the Modified Development Control Order.
