Kirby ACJ I agree with the judgment of Handley JA.
Mahoney JA I agree with the judgment of Handley JA.
The principles upon which an appellate court exercising the power which this Court exercises: cf Precision Plastics Pty Limited v Demir 132 CLR 362 at 369-70; have not been in dispute. If the present judgment had been a judgment of a judge, it is clear that it would be set aside. But, as Handley JA has indicated, it is not so clear that, being the verdict of a jury, the court should intervene.
