MUNMALARY NOMINEES PTY LTD v PITT SON AND BRYANT PTY LTD
SUPREME COURT OF NEW SOUTH WALES COURT OF CRIMINAL APPEAL
MAHONEY JA 21 October 1991
[1991] NSWCA 211
Mahoney JA In my opinion this is a proper case for the granting of an extension of time and the orders I make are the orders to which IJ have referred, namely: I order that the time for filing of a Notice of Appeal be extended to and including 4 November 1991. The order is made on condition that within fourteen days the applicant provide security for costs of the appeal in an amount and in a form to be settled by the Registrar. If that security be not given in due time, then the order is vacated.
The applicant will pay the costs of the present application.
