DIRECTIONS

1. The appeals and cross appeals including those from Rolfe J will be heard together.

2. Stena Sealink to file and serve an amended notice of appeal consistent with the leave granted by this Court which was limited to the decision of Rolfe J, such notice of appeal to be filed and served by 4 pm on 23 December, 1994.

3. Any notice of contention to be filed on behalf of Sea Containers in relation to the appeals from O'Keefe J or the appeals from Rolfe J to be filed and served by 4pm Friday 30 December 1994.

4. The solicitors for the ICT appellants to serve on the solicitors for the other parties by Spm on 12 January 1995 a draft index of the documents in the appeals and cross appeal from the decisions of O'Keefe J other than the confidential transcript and exhibits. Any objections to be notified in writing by the solicitors for such other parties to the solicitors for the ICT appellants by 6pm on 19 January 1995.

5. The solicitors for Stena Sealink to serve a draft index of the documents in the appeals from the decision of Rolfe J by Spm on 19 January 1995.

6. Liberty to apply to Handley JA on short notice to resolve any difficulties with the index. If possible such difficulties should be resolved by including disputed material with a statement in the index of the party insisting on its inclusion to enable the Court to decide who should bear the costs of its inclusion.

7. The solicitors for the ICT appellants to serve a draft index to the confidential appeal book on the solicitors for Sea Containers and Buquebus by 5pm on 12 January 1995. Any objections from those solicitors to be notified in writing to the solicitors for the ICT appellants by Spm on 19 January 1995.
