WENTWORTH v THE ESTATE OF PFN WENTWORTH

Cole AJA In relation to the notice of motion filed on behalf of the
respondent/defendant by consent I shall make an order in accordance with paral
until further order of the court.
I will decline to make 02 sought in that notice of motion.
I stand over the notice of motion, filed on behalf of the appellant/claimant until
the hearing of the appeal.
I direct that the appeal be given the highest category of expedition and be
referred to the Registrar for allocation of an appropriate hearing date.
I note that the index to the Appeal Books is to be settled today. I would also
make
directions tomorrow for the exchange of written submissions within 14 days of
preparation of the Appeal Books.
I shall publish some reasons tomorrow as to the reasons for the orders I have
indicated. Without filing a submitting appearance, I direct that ANZ Executors
and Trustees Company Ltd be added as a second cross-respondent to the appeal
ordered by the respondent Peter Fitzwilliam Neville Wentworth, and that the
ANZ Executors and Trustees Company Ltd also be a respondent to the appeal
sought by the appellant/claimant Katherine Wentworth
I grant leave to file in court an amended Notice of Appeal.
I direct detailed submissions in relation to each ground of appeal which is
intended to be pressed, both of a legal nature and by reference to the detail of the
evidence in the Appeal Books.
I shall grant liberty to apply. I shall deliver brief reasons at 10 am tomorrow
