Clarke JA This appeal concerns a fall by a forty-nine year old woman in the vicinity of the footpath outside the Coles K Mart Store in Fox Street, Ballina. The fall occurred at about 12.55pm on 3 November 1991. She sued the respondent, Coles, claiming that as an occupier of the area of land on which she fell it had been negligent and its negligence caused her injuries which were indeed quite serious.
