Sheller JA. In this matter the name of the respondent was called outside the court; the respondent did not appear. Mr Collins, the solicitor for the claimant, gave evidence of service of this notice of motion and the claimant has given evidence by way of an affidavit by Mr Collins explaining why this notice of appeal was not filed within the time allowed consequent upon leave to appeal being granted. I am satisfied that it is an appropriate case in which to grant the extension sought.
Accordingly I make the following orders:
1. Extend the time for filing the notice of appeal up to 4pm on 4 June, 1996.
2. The claimant to pay the opponent's costs of this application.
3. The claimant to serve a copy of this order on the opponent's solicitors by 4pm on 7 June, 1996.
