[1997] NSWCA 229 Registrar Jupp. The appellant claimant has filed a Notice of Motion seeking:
(1) further directions to the claimants.
No other orders are sought. I have sought clarification from Mr Norris, who appears in person today, as to what specific orders the Court of Appeal can make to assist the conduct of this appeal.
This appeal is awaiting hearing in the ordinary course and should be listed for hearing either towards the end of this year or early 1998. An earlier application for expedition was refused.
As far as I can see there are no other matters that the Court of Appeal can do to assist Mr Norris except ensure that the appeal is heard as soon as possible.
Under those circumstances there are no orders that I can make in respect of the notice of motion. I am required under those circumstances to dismiss the motion. As the opponent has been brought here today unnecessarily the motion must be dismissed with costs.
