In this matter the claimant seeks an order for an extension of time for leave to appeal and an order that leave be granted to appeal the decision of his Honour Acting Judge Gallen delivered on 11 April 1996.
The summons was filed by the claimant and on 19 September 1997, a very considerable delay. The Court is not persuaded that this is a case in which an order for an extension of time should be made. Accordingly, that application is refused and the summons is dismissed with costs.
