DECISION: [41] It follows that I would allow the appeal in part. I would set aside the order below. In lieu thereof I would order that Mr Swansson be tried separately and apart from Mr Henry and Mr Gravett but that, subject to further order, that Mr Henry and Mr Gravett be tried together.
