The appeal is allowed. ; 2. Orders 1 and 2 of the Tribunal, awarding damages to the Respondent to the appeal in the relocation or disturbance of trading claim and the balcony claim respectively, are set aside.; 3. The Respondent's applications in each of these two claims is to be reconsidered by the Tribunal in so far as they rely on any alleged breach of s 52 of the Trade Practices Act 1974 (Cth).; 4. The Respondent's application in the relocation or disturbance of trading claim is to be reconsidered by the Tribunal in so far as it relies on any alleged breach of s 34 of the Retail Leases Act 1994.; 5. The following questions relating to the Tribunal's reconsideration of these aspects of Skiwing's claims are to be determined by the Appeal Panel at a hearing to be arranged by the Registry: -(a) How the Tribunal should be constituted.(b) Whether and if so under what conditions the parties should be permitted to adduce further evidence.(c) Any other procedural issues requiring determination.; 6. The costs of this appeal are reserved.
