JUDGMENT IN FAVOUR OF: Respondent
The complainant, Mr Terry John Leggatt, was employed by the Electricity Commission of New South Wales (trading as "Pacific Power" and hereinafter called "Pacific Power") from February 1976 until 13 January 1995.
The respondent is the Electricity Commission of New South Wales (trading as "Pacific Power").
On 17 March 1989 Mr Leggatt lodged a complaint against the respondent alleging discrimination in the area of employment on the ground of physical impairment under section 49A and section 49B of the Anti-Discrimination Act, which provides:
"49A. (1)
A person discriminates against a physically handicapped person on the ground of his physical impairment if, on the ground of -
(a) his physical impairment;
(b) a characteristic that appertains generally to persons having the same physical impairment as the physically handicapped person; or
