1. Verdict and judgment for the plaintiff against the defendant in the sum of $473,247 plus interest from 20 March 2006 to 22 January 2010 in the sum of $174,128.96. DECISION: 2. The defendant is to pay the plaintiff's costs on the ordinary basis up to and including 22 April 2009 and on an indemnity basis from 23 April 2009 onwards. 3. The exhibits are to remain with the file, to be returned on application by the parties to the Registry after 28 days.
