1. The plaintiff, An Phan Tran, claims damages in respect of injuries received in a motor accident on 5 July 2006.

He contends that in the course of riding a motorcycle east along Cabramatta Road he was forced off the road into the kerb by a black sedan that changed lanes suddenly and without warning, causing him to crash. He alleges that the accident was caused by the negligence of the driver of the black sedan, the identity of which has not been established after due search and enquiry.
