JUDGMENT IN FAVOUR OF:
The Tribunal has considered the matters that have been put before it this morning concerning an application under section 111(1) of the Anti-Discrimination Act, 1977, for the complaint, made by Mr Horwood against the Ryde-Hunters Hill Community Housing Co-operative, to be dismissed on the ground that the Complainant was unable to substantiate the claim. The Tribunal has considered the material that has been put before it at this stage which comprises the President's Report and four other exhibits.
The complaint has been brought before the Tribunal pursuant to section 91 of the Anti-Discrimination Act, 1977, following a finding by the President of the Anti-Discrimination Board that the complaint had not been substantiated . At the request of the Complainant, the complaint has been referred to the Tribunal for inquiry.
Under section 111(1) the Respondent is entitled to bring the application at any time in the proceedings and has sought in this matter to make the application prior to any formal evidence being brought before the Tribunal.
